5 AI workflows for real estate agents and loan officers, with the compliance lines drawn

Short answer

Use AI to speed up your own communication and marketing: open house follow-up, listing descriptions, buyer education, co-marketing drafts and weekly recaps. Be careful when AI tools or AI-made content become something of value you give a referral partner. RESPA Section 8 prohibits giving or accepting anything of value for referrals of settlement service business.

1. Open house follow-up

Agent or LO, the follow-up is where deals are won and where time disappears. Give your assistant your voice and ask for two short versions of a follow-up text. Make sure you have consent before texting anyone; TCPA rules apply to marketing texts and calls.

2. Listing descriptions

Paste your walkthrough notes and ask for a description that uses only the facts you provided. Add a fair housing guardrail to your instructions: describe the property, not the people. Avoid language about who a home is "perfect for."

3. Buyer education

First-time buyers ask the same questions every week. Have AI draft plain-English explainers on escrow, inspections, appraisals and closing timelines. Keep rates, dollar figures and approval promises out, and have the licensed professional review before it goes out.

4. Co-marketing drafts

Agents and LOs often market together. AI can draft the copy fast. The compliance question is who pays for what: co-marketing costs generally need to be split in proportion to each party's use. Run joint marketing by your compliance team. Housing and credit ads on Meta belong in the Special Ad Category.

5. Friday recap

Paste your week's notes, with initials instead of client names, and ask for: deals that moved, follow-ups owed, partner touches and three priorities for Monday. Fifteen minutes on Friday saves an hour on Monday.

Where the lines are

  • RESPA Section 8. Paying for a partner's AI subscription, or building them done-for-you content in exchange for referrals, can be a thing of value. Teach and share ideas, but get compliance sign-off before giving anything of value.
  • Fair housing. Review AI-written listings and ads for language that steers or describes people instead of property.
  • TCPA. Consent first for marketing texts and calls, however they're written.
  • No rates or promises. AI drafts shouldn't quote rates, APR or approval odds.
